The requirements of the Federal Coal Combustion Residuals Rule are evolving and ambiguous.  This presentation will highlight the challenges and opportunities associated with the Groundwater Monitoring and Corrective Action part of the rule in its current status, and potential changes that should be taken into account for an effective compliance program.  You will learn what ambiguities and opportunities exist in the current rule, how they affect remedy selection, how forensic tools might be used to avoid, or limit, the scope of groundwater corrective measures, and key issues that may arise during public involvement in the remedy selection process.

Part 2:  The Federal Coal Combustion Residuals Rule:  Forecasting Significant Changes from EPA’s New Requirements
Wednesday, December 4, 12:00 pm – 2:00 pm CT

US EPA provided notice in the Spring Administrative Policy that it would be seeking to publish four major rulemaking efforts that would amend the Federal Coal Combustion Residuals Rule.  This presentation will summarize changes that EPA is proposing and highlight areas that are expected to be impacted by these amendments to the federal rule.  Perspectives of opportunities and risk as it relates to utility operations and long-term stewardship and liability will also be addressed.
