  Section Meetings
The Midwest Section usually meets the second Wednesday of September, October, November, January, February, March, April, and May.

The time and location of the meetings varies, the meal cost also varies but is typically in the range of $15. The Section also typically hosts a holiday event during the early part of December. Everyone is welcome and reservations should be made by noon on the Monday preceding the meeting by calling Jo Moore at 913-648-1571. You can also register for the meetings by sending Jo an email at themoores4@mindspring.com including your name, company, and number of people that will be attending the meeting. All meetings (with the exception of the holiday event) include a presentation on relative topics to the environmental professional.

The Section also hosts an annual technical conference, as well as various specialty conferences.

Offer your technical skills and expertise to MARC in updating the Region's Clean Air Action Plan (CAAP). The CAAP is a voluntary strategy for reducing ground-level ozone pollution in the KC metropolitan area that compliments the SIP ozone reduction strategies. For reference, here is a copy of the May 2005 CAAP. http://www.marc.org/Environment/airQ/clean-air-action.htm The current CAAP is primarily based on four voluntary control strategies: (1) power plant controls; (2) diesel engine controls; (3) public education; and (4) sustainable measures. The goal of the CAAP was/is to secure voluntary commitments in these four areas. In conjunction with MARC's update of the CAAP, they are seeking volunteers to assist in developing recommendations for the updated CAAP. In particular, MARC expects to host a large public event to draw comments and input from a large variety of stakeholders. My understanding is that the volunteers would assist in: (1) planning before the large public meeting; (2) facilitating the large public meeting; (3) refining the ideas and identifying ways to implement ideas presented at the meeting; and (4) working on the follow-through of voluntary commitments and drafting of the CAAP, as necessary and applicable. Of the four voluntary control strategies, the first two areas have already been very successful, whereas the remaining two (public education and sustainable measures) are the two areas that MARC would like to see new improvements in the CAAP. In short, ways to improve public education and sustainable measures as a means of reducing air emissions and ozone will be the primary focus areas (unless, of course, someone from our group has another idea). In terms of timing, MARC hopes to have the CAAP-update completed by March 2011. The large public meeting will likely be held sometime in late July 2010. The good news is we still have time to become involved in this opportunity. The bad news is that we need to act fast if we have folks that do want to get involved.The next meeting with MARC will be on Tuesday, May 11.

Tom will describe how the region's Sustainable Skyline's Initiative builds upon the 2004 Clean Air Action Program to help frame the formulation of long term sustainable policies, plans and projects. With the lower standard, it is thought that Kansas City will be forced to go non-attainment. Audio+Web presentation of New Source Review Program

The Supreme Court has weighed in on the controversy swirling around the New Source Review program. With its unanimous decision to overturn past rulings on the Duke Energy case, the court has asked EPA to re-evaluate the NSR rule, and work on new applicability provisions. Additionally, EPA has said it will continue with even more changes to the NSR rule that it was considering prior to the ruling. The modernization and competitiveness of many energy facilities is subject to the on-going debate over NSR, making compliance with the rule a daily challenge. It is no surprise that the NSR program is confusing and complicated. The rule remained virtually unchanged from its inception in 1980 until 2002. Since that time, new applicability tests and record-keeping requirements, new rules on de-bottlenecking and project aggregation, and updates regarding non-attainment requirements in new non-attainment areas were introduced, resulting in a flurry of court cases, decisions on which continue to confuse those seeking compliance. On Thursday, Sept. 6, at 1 p.m., Gary McCutchen of RTP Environmental, a key implementer of the NSR program from 1980-1992, Ken Weiss of ERM, Inc., an expert on NSR permitting and issues, and John Paul, a Supervisor of the Regional Air Pollution Control Agency (RAPCA) will be weighing in on behalf of the National Association of Clean Air Agencies to discuss topics related to facility renovation and new construction in an Audio+Web presentation. The “Clearing the Air on NSR” Audio+Web also provides updates on the current status of the program, including reviews of EPA’s latest anticipated changes and the current state of the program throughout the country.

Truth and Consequences: Environmental Audit Privilege and Immunity

As environmental laws have matured over the past several decades, the regulated community in general has become more proactive concerning the impact of their businesses upon the environment. They began reviewing their equipment and operations to evaluate whether they could be made more environmentally efficient. These internal investigations, some of which were reduced to writing, became known, generally, as environmental audits and the old privilege conflict was renewed in this young area of the law. The issue which arose was whether environmental audits were discoverable or whether they should be protected. More specifically, should a company risk investigating itself and documenting it if violations of environmental laws are not privileged and, therefore, discoverable? Some states have attempted to resolve the conflict by enacting environmental audit privilege statutes. These statutes provide limited protections to environmental audit reports under certain circumstances and some offer one form or another of immunity from prosecution or reduced penalties. There are limitations, however, to these state privilege statutes. Perhaps the most serious deficiency of the state statutes is that their protections are not generally recognized by the United States Environmental Protection Agency ("USEPA"). Bob will offer some practical suggestions for maximizing the safe harbor potentially available in the USEPA Policy in conjunction with state environmental privilege and immunity statutes.

The Sugar Creek II preheater/precalciner kiln system received a PSD construction permit in 1997, began operating in 2002 burning coal, petroleum coke and natural gas. The 2004 project will allow burning of the following alternative fuels: tire and plastic derived fuels, #2 and #6 fuel oil, carpet, landfill gas, used oil, animal meal and cellulose (wood chips, sawdust, paper).
